This fast-paced webinar will discuss likely changes under the Biden Administration at DOL, EEOC, and NLRB concerning the FMLA, FLSA, ADA, and NLRA.

Topics will include:

  • ADA & EEOC

    - Evolving COVID-19 “work-at-home” issues involving employees at high risk because of underlying physical issues, employees with mental health issues, or employees who simply fear being in the workplace;

    - Other accommodation questions including long-term/indefinite leave, schedule modifications, PPE modifications, and parking spaces for employees who don’t want to take public transportation;

    - Testing issues, including temperature checks of employees and confidentiality protocols;

    - Whether employers may require vaccinations or may give preference to individuals with antibodies and whether employees can be required to submit documentation of antibodies, and reasonable accommodations for individuals who cannot get vaccinations;

    - Possible changes to EEOC positions on ADA reasonable accommodation topics such as the definition of "reasonable," leave (including unpredictable leave), reassignment, and requests for a change in supervisors or an irritant-free environment.

    - Who is the Commission now – in the Biden-Harris Administration; Who is the General Counsel; What does the composition of the Commission and the General Counsel mean going forward into the Biden Administration;

    - Policy items that just got completed at the end of the Trump Administration: Rulemaking on Conciliations; Updated Compliance Manual section on Religious Discrimination; new Opinion Letters under Title VII; What’s happening with the Conciliations and Mediations pilots;

    - Items to expect under the new Biden-run-Chair: what will happen with wellness regulations; the pay data collection (EEO-1, Component 2) and Pay equity; Enforcement Guidance on Harassment; Telework – what to expect post-COVID.

  • FMLA

    - Status and likely outcome of DOL’s request for comments on FMLA regulations;

    - Whether paid family leave at the federal level will actually be implemented;

    - How FMLA will coordinate with the various state paid leave laws that have gone into effect and/or are going into effect;

    - How to prepare for increased enforcement and tips for navigating on on-sites/virtual on-sites.

  • NLRA

    - Steps the Trump Board may take over the next 9 months to cement its legacy;

    - How the COVID pandemic continues to affect labor relations;

    - Likely composition of a Biden NLRB;

    - The likelihood of a return to the opinions and policies of the Obama Board.

  • FLSA

    - The likelihood of rescission of existing Executive Orders and issuance/reinstatement of new EO's;

    - The impact on recently passed rules and pending legal challenges;

    - Changing enforcement priorities for DOL;

    - Analysis of possible new laws covering everything from the minimum wage to the validity of noncompete agreements.
