Recognizing bias, achieving racial equity and building a culture of inclusivity.

This Webinar will be moderated by NELI's ADA Training Director, David Fram, and presented by Terry Johnson, David Bowman and Jocelyn Cuttino all with Morgan, Lewis & Bockius LLP.

We are in a moment. A moment where recognition of racial injustice has seared the national conscience. A moment where stories of #MeToo are continuing to be heard, and where employees are raising their voices about critical racial, ethnic, and social justice issues.

These are important but challenging times for employers as they navigate increasing demands from employees, customers, boards, investors, and the general public to create more diverse and inclusive workplaces.

During this session, we will take a deep dive to examine how employers – from Main Street to Wall Street – can create, promote, and maintain more diverse and inclusive workplaces. Not only is this a response to today’s current social, political, and cultural climate, but it is also an attempt to reap the many benefits that diversity inherently brings to the workplace.

This will definitely be a “legal discussion.” We always explore the legal parameters of building an effective diversity and inclusion program. For instance, we generally discuss whether cultural assessments and investigations are protected by the attorney-client privilege. We discuss the legal risks of setting diversity goals, and how those goals could potentially be seen as impermissible quotas. We also discuss diversity recruiting methods that we believe are permissible under the law, such as diverse interview slates. And the list goes on.
