For over two decades, Ellen Boshkoff has represented employers exclusively (both public and private) and has defended employment cases in federal and state courts across the country. Her experience includes defending class actions and wage/hour collective actions.
Significant reported decisions in cases in which Ellen served as counsel include: Garwood Packaging, Inc. v. Allen & Co., Inc., 378 F.3d 698(2004) – Defended New York investment banking company against multimillion dollar promissory estoppel claim; summary judgment upheld on appeal. Board of School Commissioners of City of Indianapolis v. Walpoole, 801 N.E.2d 622 (Ind. 2004) – Prevailed in emergency appeal to the Indiana Supreme Court in case involving issue of whether discovery is required prior to teacher termination hearing. Wal-Mart Stores Inc. v. Bailey, 808 N.E.2d 1198 (Ind. App. 2004) – Co-counsel for Wal-Mart in state wage and hour class action; certification reversed on appeal.
Trial experiences include: Jury trial in pregnancy discrimination case in Portland, Oregon. Jury trial in sexual harassment case in the Southern District of Indiana. Jury trial in FMLA retaliation case in the Southern District of Indiana. Jury trial in age discrimination case in the District of Wyoming.
